FASTMAX Terms of Use (Plain-Language Version)

FASTMAX is run by Intelligent Tax Technologies LLC, 2261 Market Street Suite 46119, San Francisco, CA 94114 ("FASTMAX," "we," "us," "our").
1. Welcome
FASTMAX helps you get your taxes done quickly. We use smart tools plus real, registered tax preparers to prepare and file returns for you.
By using FASTMAX, you're agreeing to these Terms. If you don't agree, don't use FASTMAX.
2. What FASTMAX is (and isn't)
- FASTMAX is not do-it-yourself tax software. Your return is prepared by a registered tax preparer who signs it with their PTIN and files it after you approve it.
- FASTMAX is not a law firm. We provide tax preparation services, not legal representation, unless we agree to that separately.
3. Who can use FASTMAX
You need to be at least 18 and able to legally agree to a contract.
If you're using FASTMAX for someone else (like a business or a family member), you're promising you're allowed to do that.
4. Your account
To use some features, you'll need an account. You agree to:
- give accurate info when you sign up,
- keep your password safe,
- tell us if you think someone got into your account.
Anything done through your account is treated as done by you.
5. How the service works
- You upload or enter your tax documents and info.
- Your FASTMAX preparer reviews it and may ask follow-up questions.
- They prepare your return.
- You review it and approve/sign it.
- They file it.
We rely on what you give us. We don't independently audit your records — but we do ask questions if something looks missing or inconsistent.
6. Responsibilities (this part matters a lot)
6.1 What you are responsible for
You agree to:
- give us complete and accurate information,
- answer questions honestly and promptly,
- review your return carefully before approving/signing,
- not approve anything you know is wrong or incomplete,
- pay any taxes you owe on time.
Even with a preparer, the IRS treats you as responsible for your return once you approve/sign it.
6.2 What we (and our preparers) are responsible for
- follow IRS rules and professional standards,
- use due diligence based on your info,
- prepare the return correctly from those facts,
- sign it with a valid PTIN,
- give you a copy of the filed return.
6.3 If there's a mistake
- If something is wrong because your info was missing, incorrect, or dishonest, you handle the consequences.
- If something is wrong because our preparer made an honest mistake, you are still responsible to the IRS for any extra tax.
- If that honest mistake causes penalties or interest, you may be reimbursed under Section 12 (but that reimbursement is limited by Section 15).
7. Prices, billing, refunds
Some FASTMAX services cost money.
If you buy a paid service, you agree to:
- pay the price shown at checkout,
- pay any required taxes,
- understand fees are usually non-refundable unless we say otherwise in writing.
If we add subscriptions later, they'll renew automatically unless you cancel before renewal.
8. Using FASTMAX the right way
We give you a personal, limited right to use FASTMAX for lawful tax prep.
You can't:
- copy or resell FASTMAX,
- reverse engineer it,
- scrape it, overload it, or hack it,
- use it to build a competing product.
9. Stuff you can't do
Don't:
- use FASTMAX to break the law,
- upload malware or harmful files,
- harass our preparers or staff,
- interfere with other users,
- pretend to be someone else.
We can suspend or terminate accounts that violate this.
10. Your data
You own what you upload ("Your Data").
You give us permission to use Your Data only to:
- provide FASTMAX services,
- prepare and file your return,
- keep things secure and prevent fraud,
- improve FASTMAX using aggregated or de-identified info,
- follow the law and our Privacy Policy.
You're responsible for Your Data being accurate and complete.
11. If you delete your account
You can delete your FASTMAX account anytime.
When you do, we'll remove your data from our active systems as much as we reasonably can.
But tax preparers are legally required to keep certain records for a period of time, so deleting your account doesn't always mean every piece of tax-return data can be erased immediately.
We only keep what we're required to keep, and we protect it the same way we protect everything else.
12. Penalty & interest reimbursement (accuracy guarantee)
We aim to prepare accurate returns using professional standards.
If you pay IRS or state penalties or interest only because of a clear, unintentional mistake made by a FASTMAX-signed preparer, we will reimburse those penalties/interest.
This does not cover extra tax owed or a smaller refund.
This also doesn't apply if the problem was caused by:
- missing or inaccurate info you gave us,
- fraud or intentional wrongdoing,
- not responding to reasonable preparer questions,
- approving/signing a return you knew was wrong,
- failing to file or pay on time when you were responsible to do so.
13. Maximum Refund + Best Price Guarantee
We want you to get the biggest refund you're allowed to get and pay a fair price for professional prep.
If you use FASTMAX and later find a comparable professionally-prepared return that:
- cost you less, and
- gave you a higher refund (or lower tax due),
using the same underlying facts, then we'll make it right. We will either:
- fix your FASTMAX return for free (including an amendment if needed), or
- refund the FASTMAX fee you paid for that return.
A few simple rules:
- The comparison has to be professionally prepared (not DIY software).
- It has to be for the same tax year and same taxpayer(s).
- The higher refund can't be because you gave that other preparer different info, or because they took a position that isn't supported by law.
- Tell us as soon as you notice the difference, and no later than 60 days after your FASTMAX filing (or October 31 of that tax year, whichever comes first).
That's it. If those things are true, you're covered.
14. No promises about outcomes
We can't promise a specific refund, a specific tax result, or that you won't be audited.
Results depend on your facts and the law at filing time.
15. Service is "as-is"
We work hard to keep FASTMAX accurate and available, but sometimes stuff goes wrong (bugs, downtime, third-party issues, etc.). So FASTMAX is provided "as is" and "as available."
16. The one big limit on liability
If something goes wrong, our total liability to you is limited.
The most FASTMAX could ever owe you for any claim is whatever you paid us for the service involved, but never less than $100.
This covers everything — including claims about preparers and any guarantees in these Terms.
We're also not responsible for indirect losses like lost profits, lost business, or lost data.
Some states don't allow every part of this, so we apply it as far as your local law allows.
17. If your actions cause us trouble
If you misuse FASTMAX, break these Terms, or give us illegal/false info and that causes us losses, you agree to cover our reasonable costs.
18. Ending your use
You can stop using FASTMAX whenever you want.
We can suspend or terminate your access if you violate these Terms or create risk for FASTMAX, our preparers, or other users.
19. Disputes and governing law
If there's an issue, contact us first — we want to fix it.
If we can't fix it informally:
- Governing law: California
- Where disputes happen: courts in San Francisco County, California
If you want arbitration/class-action waiver language, we can add it later with counsel.
20. The boring legal leftovers
- If one part of these Terms can't be enforced, the rest still applies.
- If we don't enforce something once, that doesn't mean we won't later.
- You can't transfer your rights under these Terms without our written okay.
